Title: Left Schengen and re-entered
Post by: Allnighter86 on February 29, 2016, 07:40:49 pm
Hi there! I entered the Schengen area in December, staying for a few weeks. I travelled overland from Hungary to Bosnia (Not EU or Schengen) at the start of February. When I left Hungary, I was processed at the border with Croatia and given stamps for leaving HUngary and entering Croatia. Same thing when I went to Bosnia. After spending some time outside, I returned to the Schengen Area via bus to Italy (briefly passing through Slovenia). When I came back into the Area though, I was not stamped (they didn't even check passports!). How do I account for the days I was out of the SA? I'm going to be pushing the 90 day limit, but if authorities don't recognize the days I wasn't in the SA I will definitely be over 90. Do I try to demonstrate that I was out of the Area by showing my (illegible) stamps from leaving? If there is a record of my departure but no record of my re entry, how do they even know how long I have been here. Thanks!

It would work this way. If you get questioned upon leaving from the Schengen area after more than 90 days, they will object that you have overstayed your Schengen visa. Then, it will be up to you to explain the reason for overstaying. You can argument that you have not overstayed because you have been out for some days, but you did not get stamps upon re-entering. It will be up to you to prove that you were outside the Schengen area. The outcome of the discussion will be at the discretion of the border patrol, he might or he might not believe you. Thus, you should to have a travel tickets and anything else (for example hotel receipt from Bosnia) as a proof with you.
