Title: Do I need to wait for the 180 period to expire before being allowed 90 in Scheng
Post by: swat on January 17, 2018, 06:19:41 pm
I entered Schengen September 24, 2017 and left November 21, 2017 (58 days). I will remain outside of the Schengen area for 90+ days but want to re-enter before the 180 period is over and stay 60 days. In other words, I want to re-enter on February 23, 2018 (94 days OUT of Schengen). This means I am still at 152 days of the 180 day period. Do I need to wait for the 180 period to close before I can stay ~90 days again? Or is staying out of the Schengen for 90+ enough to reset? Thanks

No, you do not need to wait until the 180 days period is over. If you arrive on 24/09/17 and leave on 21/11/17, that gives you 59 days in the Schengen zone. Then, if you enter the Schengen zone on 23/02/18 and leave on 23/04/18, that gives you another 60 days. In total, you will have spent 119 days in the Schengen zone; that is however within 212 days. Now, when on 23/04/2018 you look 180 days back, that brings you to 26/10/17 - that is your new 180-days-period start date. When considering this new 180 days period, dates between 26/10/17 and 23/04/2018, you will have spent 87 days in the Schengen area which satisfies the 90/180 rule.
