Title: Foreign wife treated as citizen for tax purposes?
Post by: nolosoft on March 12, 2010, 06:20:34 pm
I am H1B holder and my wife is Thai. She is a student here. We file taxes together. Is she treated as a foreign national or as a resident?

It depends on how you file taxes. If you file taxes individually, then she would be treated as foreign national. If you file as married filing jointly, then she would be treated the same way like you, that is as a US resident.
