Title: I overstayeda schengen german tourist visa. Can I apply a study visa D in Spain?

Hello everyone,

Im a national from Colombia and I arranged a schengen visa to Germany on 2011. But I had some difficulties and I overstayed for a month and got caught in the border of France and Spain. I was trying to get to some relatives in Spain. The police of France and Spain took my finger prints but then let me free in Spain. All this happened with a regular passport I had but I got stealed in Barcelona and I had to arrange a new passport (biometric with chip). And then I went out from europe from Madrid. Am I able to apply for a study visa to Spain? or do you think Im not allowed to apply for any kind of visa anymore? Is there a way how to check if Im reported or If I have a record on the euro-schengen border system?

Please comment, any information would be very appreciated.

If you got caught by the border police, you most likely have a record in their system. That however does not prevent you from your ability to apply for a visa. You can apply. The only bad thing that can happen to you is that your visa application will be denied. Offences also loose their weight as time progresses. Your overstaying visa can result in your visa application being denied this year, but it might be disregarded by the decision making officer in 5 years from now. By the way, did you have to pay some fine when you got caught for overstaying?

No, I didnt need to pay any fine. They gave me 15 days to leave europe, so I went to Barcelona (where I got stolen this passport) and I had to arrange a new one which was clean with no stamps and with a different passport number. Then I left Europe from Barcelona (sorry before a said Madrid). When I went through the police control in the airport without problems, they did ask me where was my visa sticker but I showed the denounce that I got stolen. So they let me through. So yes, my doubt is: if I apply for a student visa now with my new passport, would they see me reported or with any records? ... I dont know :(

I think you were very lucky. The fact that you have a new passport does not mean anything. If you have any bad record, you have it in their system. The question is whether you have any bad record on file.
