Hi,

Based in Tanzania, been refused a Dutch Schengen Visa after having 2 previous Schengen Visa for Sweden and Hungary. Based on not having sufficient funds, which is my fault. So i added cash in my account and had to send my appeal to NL. Thus, i sent my application by UPS.

How long does it take for a decision?

It depends on the embassy. Some embassies turn it around in a few weeks, some take months. I would wait 30 days and then I would start to inquiry.

Hello I have pakistani passport .
I recently applied for student visa to study in Italy which has been rejected can any one  please guide me on how to make an appeal,

There are three reason stated there.

1) The documentation submitted in support of visa is unreliable.
2)your intention to leave the member state before the expiry of visa cannot be assured.
3)you did not prove the means of subsistence under interior ministry directive  of 2000.

Wow, quite many reasons for rejecting the application. You submit the appeal to the embassy where you applied for the visa. You have 15 or 30 days to file the appeal (it should say in the letter), the sooner you file the appeal, the better. Here is a link to a sample visa appeal (sample visa appeal (http://www.euro-dollar-currency.com/sample_visa_appeal.htm)). This is only a sample, edit and customize the text to suit your situation.

When you file the visa appeal, you need to prove that you are right about all the denial statements.

1) courses registration, supporting letter from the school, information about the study programme, boarding agreement, fee receipt, etc.
2) information about your family, residence, etc. which suggests that you have a place to return after your study is completed
3) bank account statement, credit card statement showing credit limit, etc.

My name is Adebayo Soji from edo state nigeria and I graduated from Ambrose Alli University ekpoma and currently awaiting my nysc by august. And I was sent an invitation letter from a friend in switzerland to come visit her for 2weeks, she is a citizen of switzerland and have been to nigeria before to see me infact I was the one who even invited her down with an invitation letter from me to her and she was very comfortable when she came down here to nigeria and now she wants me to come visit her too in switzerland. But just few days ago my visa was refused despite all the documents I provided like a letter from my school, insurance,bank statement and even my result from school to state I'm a student and as at the time I applied my callup letter for the nysc was not out yet but it just came out now and I was already denied the visa with reasons that;
#the information submitted regarding the justification for the purpose and conditions of the intended stay was not reliable
#your intention to leave the territory of the member states before the expiry of the visa could not be accertained.

I don't know the reason for this. Was it because she's older than me? Because she is 47 and I am 25years old and as at the time the visa was being processed she was on vacation in the united states so could this be the reason? Or is it because she did not mention in her letter that the date I was to return to nigeria? Or is it because I have a virgin passport? And I have booked a appointment for an appeal but my question is would this be a gurantee? Because have spent so much money and had gone through a lot of stress too or should I reapply again? Please I need advice on what to do next. Please I need your reply as soon as possible. Thanks

My opinion is that your reason for denial was a combination of all those facts. Your option is to appeal the visa denial.

Hi guys! My schengen visa is denied :( and the only reason is "Justification of purpose and conditions for the intended stay was not provided" - I dont totally understand the reason of refusal and i dont knoe what else i need to provide? Im applying for Luxembourg visa. How can make an appeal for this refusal reason. Help please. Thank you.

Hello,

I am from India, recently I got a job in a MNC. This is my first travelling out of my country. I got a special recommedation letter from the company for my visit to switzerland, then also my visa got rejected twice. Reason was "your intention to leave the member state before the expiry of visa cannot be assured."

I Got the special recomendation letter from the company, my tickets, hotel, issurance, meals and all expenses was to be covered by the company and it was written in the letter as well as every documents was submitted. Then also it was rejected twice. What should I do because this was the best I can do to get the visa.

Since you have been denied the visa twice already, a new application most likely won't help. Your option is to file an appeal. See the posts above on how to do that.

Hello,
My mother and brother applied for Schengen visa from Bangladesh. The reason of this travel was pilgrimage in portugal . Because we don't have any Portuguese embassy in bangladesh we need to apply through French embassy. However their application was refused and reason stated as , "Your intention to leave the territory of the member state before the expiry of the visa could not be ascertained". Now my question is in the appeal letter do we need to rebook hotel, air tickets again? My mom is a pious catholic woman and she made a prayer to meet Virgin Mary of Fatima. In this situation I am really confuse how  to help her . She is 63 years old. Please help me . Thanks in advance .

It depends on how much time is left before your departure. If you appeal the negative visa decision, the appeal usually takes somewhere between 10 to 60 days, depending on the situation, embassy, etc.

hi,

 I applied Schengen visa to Denmark but it was refused because of the reasons i overstayed for 13 days, for that matter happens when they send me a letter of rejection to my apply of permit to stay because i send my application wrongly without my biometric specimen but i ask them if i can send it to follow, to the person we talk first, she agreed but when we try to relay that we already been to the police for my biometric they dont accept for we talk to another person, the first person we talk *(sadly we dont get the name) said she will put mark on my case, that  ill send my biometric the next day (thats what we did) but second person we talk dont agreed about it, she said that the first person dont write anything on my case. So i dont have no choice but to go home my Danish husband called them again to ask for the second time if they could accept that but their decision is no  and i shoud go home but we ask if i could go home in the last week of the month since my husband can get his money on that time but they said i should go the first flight after i recieved their letter but we waited till we the  money. Thats why i overstayed for 13 days .. My question can I make an appeal since this is the fifth time i get visa to Denmark .

can I make an appeal since this is the fifth time i get visa to Denmark .

You can appeal the visa decision any time, regardless of how many time you have been to Denmark or any other place.

The Schengen Acquis does not impose any limit on how many times you can apply for visa, or how soon after your previous visa or denial.

One of the reasons for my refusal of visa was that the nature of the visit was clear/stated. I was not part of a tour so I did the itinerary by myself, with 32 days of travel. If I appeal, would it be wise to join a tour so that I can I have a more formal itinerary vetted by a travel agency. My concern is that if I do that, the documents that I submitted before pertaining to my itinerary would become unusable, including a change in the number of days requested. 

Do you think I can change the itinerary in the appeal (by joining a tour) or should I just stick with the itinerary that I submitted?

Any help/feedback would be appreciated. Thanks!

i travelled to france in 2011 with tourist visa c mult, valid from 10/11/201 until 24/11/2011,i arrived france on the 11/11/2011 and also left 23/11/2011 before the 24/11/2011 that my visa is to expire, hope leaving france a day before my visa expires wont make it difficult for to get another visa and how long visa can i apply now since i want to travel with my family of two. i also hold a valid 2 yrs US tourist visa. please advise

The purpose of visa appeal is to get higher authority to review whether all information submitted in your original application was correctly evaluated. When appealing the visa denial, you should either state new information, or bring attention to the information which obviously was not fully considered. Other information, such as changes in your plan can go both ways. You can mention in your appeal that you wish to join an official tour, it might help, but it might be a double-edged sword too. Depends on who reads the appeal, he can either think "ok, this guy is nice, he is trying whatever he can, he even wants to join a tour", or he may think "so, what do you want, make up your mind - deny". So, you might want to mention it, but you need to be careful about how you word it.

I am Afghanistan business passport holder, living in Dubai as resident with my family for last 10 years. I am owner of a free zone company. I submitted my application for Italy visit visa. My visa is refused and the consulate letter marked the 1. means my visa is refused because of false or fake travel documents. I contact the agency they prepared ticket and hotel booking for me. They said they 100% guaranty that all travel documents they prepared are ok and nothing is wrong. The rest is my passport which has my Dubai resident visa and many other visas like USA, India, Turkey etc. from several years I carry only this Afghan passport which has validity. I never face any problem with this passport even I travel to USA, my Dubai resident visa also stamped for 3 years in the same passport. I don't know why they refused my visa.
Could you please advise me, How to go ahead and What to do? Disregarding the visa I am afraid of my whole business and travel record for my future visa.

How exactly is the wording on the decision from the embassy? (Sometimes, people misunderstand what the embassy writes, if you can, please, quote here exactly what is written on the letter from the embassy.) If your passport is valid, and the reason for the visa refusal was a suspiction of a false travel document, your option would be to appeal the visa decision. If your passport is relatively old and worn, you might consider getting a new one too, a new current passport provides less reasons for any doubts. In regards to your travel bookings, note that many airlines hold reservations up to 24 hours. If the flight reservation was several days old at the time of visa application, it migh have been invalid (expired) already.

Hi Steven,

They marked article 1 as (1 - A false/counterfeit/forged travel documents was presented.)
At the end they mentioned that, Application rejected under article 1 not subject to the right of appeal.
I don't know How big this rejection will affect to my future application, How to proceed with the appeal.
Please recommend any good lawyer.

Unfortunately, I cannot recommend a lawyer. The case is suspicious to me, I suspect this embassy makes up their own rules. Where have you applied for the visa, in Dubai?

Hi Steven,

I got a replay from Dubai consulate of Italy. They said that my hotel reservation was cancelled due to first Schengen visa rule.
Do you think it will affect my future application to Schengen visas? I don't have enough time to apply again and catch the summer holiday there.
So maybe I apply next summer. Please kindly let me know if you have any good idea to increase chance of visa in next application.

Next year, you might want to try applying at some other Schengen-country consulate. The visa process depends a lot on people, officers at another embassy might be more benevolent. Get a new clean passport. When making reservations and flight tickets, get them on your own (perhaps they just do not like the agency for some unknown reason). This might increase your chances. I would definitely file an appeal (even if their letter says "not subject to the right of appeal"), if they claim your documents are false, they need to prove it (it is their responsibility to prove that your documents are false, not your responsibility to prove that they are not false!).

Dear All,
I seek your advise in letting me on below:
I currently reside in Brussels on a work assignment and I am here from may 2015 holding a valid visa ,work permit and residence permit until may2016.
I had applied for my parents visa visa for a period of 60 days to stay with me by sending them a commune invite stating that I have a rented accommodation until next year April where they can reside with me during their period of visit.I had sent all necessary documents as mentioned in their checklist along with their application along with their to and fro flight tickets but unfortunately their visas were refused with below mentioned reason

The visa is refused on the basis of artikal 32 of vcerordening (EC) No 810/2009 of the European Parliament and the Council of July 13, 2009 establishing a common code.

 

* You have not been shown to have sufficient means of subsistence, both for the duration of the intended stay and for the return to their country of origin or residence, or for the transit to a third country where you will be admitted with certainty, or to be in the position to acquire such means lawfully,

- Coverage is inadmissible: the guarantor does not have an unlimited residence in Belgium.

- No or insufficient evidence of financial coverage for the stay.

The reimbursement is not accepted. Also has concerned does not have sufficient financial resources to the submitted bank account to fund the travel and accommodation of himself and his wife (94 853) in Belgium.

Your intention to leave the territory of the Member State before the expiry of the visa could not be ascertained

Concerned offer no or insufficient guarantee of return considering he may never previously traveled within the Schengen area and also wish to be in the company of his wife (94 853) making him perhaps no family interests has increased its country origins.

I wish to submit an appeal with below additional documents proving their subsistence.

o Business registration certificate / Partnership Deed / Proof of proprietorship, or other proof of ownership
o Last 3 month’s personal & business bank account statements
o Company’s Income Tax Return for the last 2 years
o Documents showing the property ownership

Kindly help in guiding with the appeal along with how the same can be applied.I wish to understand what they mean by a registered letter,can an appeal by directly send via a post to above stated address in Belgium.

i wish to appeal for theannulment of the rejection of my parents visit visa in belgium to the Aliens Litigation office as mentioned by them but when i called them,I was told that an appeal can take a minimun of a year.
Kindly advise.

I have a question please answer me. Im so confused right now.
I applied for shenzhen visa in italian embassy octorber 13 and i have the results after two weeks and now they refused my application. They gave me a paper saying these:
1. You have not provided proof of sufficient means of subsistence, for the duration of the intended stay or for the return to the country of origin or residence.
2. The information submitted regarding the justification for the purpose and conditions of the intended stay was not reliable.
3. Your intention to leave the country of the member states before the expiry of the visa could not be ascertained.

How i can appeal in the embassy of italy here in philippines?
What do I need to do? Please help me. Because my bf paid already our tickets and hotel. :(

You write an appeal letter and submit it to the embassy. The embassy either accepts the reasons provided in the appeal and issues a visa, or forwards the appeal to a higher office (Ministero degli Affari Esteri or Tribunale Amminstrativo Regionale, TAR).
