Title: Overstay days limit in shengen within the visa period Post by: Agata Victoria on August 01, 2014, 09:11:43 pm Visa was given by Austrian embassy, for 3 week but with 7 days stay limit (short stay single entry visa). Actually, the trip was planned for 12 days - 3 days in Austria, 4 days in Spain and 5 days in Belgium or Netherlands. What are consenquences of overstaying this 7 days limit? Is it possible to avoid problems while exiting shengen and if yes, which country is better to do it from? I will be leaving to London what if i leave from Brussels by the railway (eurostar) is it possible to avoid custom check?

Officers of all Schengen countries must abide by the same rules called Schengen Acquis. Consequences of overstaying Schengen visa vary by the situation. They can range from nothing or just a warning, through a few tens or hundreds of Euro fines to being banned from further entry into the country. The scale is wide, and the consequence at the given moment depends on the officer as well as on you (the more argue, the more you pay :) ). Quote Verification of entry conditions and risk assessment 4. The consulate shall, where applicable, verify the length of previous and intended stays in order to verify that the applicant has not exceeded the maximum duration of authorised stay in the territory of the Member States, irrespective of possible stays authorised under a national long-stay visa or a residence permit issued by another Member State. |
