# Schengan 90/180 Rule confusion

Hello Everyone ,

I'm in a confused rut here , hope someone can help me .

Well I'm Malaysian, I had my project for a year in Romania , now I'm expanding to Austria , did my visa application but it's taking time as always due to holidays etc.

My question is , about the 90/180 day rule .

Well I entered in Austria initially - on the 05/07/16 and exited on the 15/07/16
Entered again- 31/07/16 and exited on 18/08/16

Then went to Germany on the - 04/09/16 and exited on the 11/09/16

If based on calculation on the 31st December would mark the day 180 .

So here's my problem :

I'm going there again on the 15th of December to celebrate Christmas and New Years as well as move in to my new apartment .

On 31st I thought I might need to exit and enter again since it's the 180 day since the first time I entered . So I can return again on the 1st in order to move in to my apartment and to have the 90 days until my visa is done .

However, so many people told me different things , so I dont know what to follow.

1) Some told me the 180 clock doesn't matter hence if I didn't finish the 90 days then the 180 days doesn't matter and I continue staying until I finish up my time .

2) Some say everyday is the start of a 180 day , so each time I enter the schengan I have a restart of some sort of the 180 day clock .

3) I don't know now how long can I still stay ? Do I have to exit and re-enter again on the 31st in order to be able to officially move in on the 1st of January ? Finally if based on the 1st opinion , how do I do the calculations?

- I'm totally confused and frassled so if zomeone could help me it would be great. Please.

I see no problem on your current situation since you are still within the 90/180 rule.

Based on the calculation, you can still use 90 days if you will (had) enter again on December 15, so there is no need to go out
of Schengen area on the 31st.

No, unfortunately, it does not work this way. The 180 days is a moving period, it does not get reset. Lets assume you have entered Schengen zone on 15th of December and will leave on 6. March 2017. Now you look back 180 days.

06. March 2017
Substract 180 days
Result: 07. September 2016

This is your 180 days period. Now you ask: How many days have I spent in the Schengen zone between 07. September 2016 and 06. March 2017?

Days of stay in the Schengen zone within the 180-days period from 07. September 2016 to 06. March 2017: 87 days

So, as of 06. March 2017 you have only 3 more days left for your stay in the Schengen zone, then you have to leave. You will be able to return after you satisfy the 90/180 rule again.
